1. Acceptance of Terms

By using the services of Creative AI ("we," "our," or "us"), you agree to these Terms of Service and our Privacy Policy. If you disagree, refrain from using our services.

2. Definitions

"Service": Monthly automation of AI-powered conversational bots for businesses.

"Client": The company or user contracting our services.

"Generated Content": AI outputs produced by the bots.

3. Service Description

Creative AI provides:

  • Implementation and maintenance of conversational AI agents.
  • Customization of dialogue flows based on business needs.
  • Monthly technical support (as per the contracted plan).

4. Registration and Accounts

Clients must provide accurate information (name, email, company details).

You are responsible for maintaining account confidentiality.

5. Client Obligations

  • Ensure data provided for bot training does not violate third-party rights.
  • Do not use bots for illegal activities, spam, or discriminatory content.
  • Comply with local data protection laws (e.g., GDPR, CCPA, Peru's Law No. 29733).

6. Intellectual Property

Creative AI retains all rights to the platform, code, and AI models.

The Client owns their input data and trademarks.

Generated Content: Client receives a usage license, but Creative AI does not guarantee its accuracy.

7. Billing and Payments

Prices in USD. Taxes apply per jurisdiction (e.g., VAT for Peruvian clients, sales tax in California).

Recurring monthly payments (non-refundable, except under applicable warranties).

Late payments: Service may be suspended after 15 days.

8. Limitation of Liability

Creative AI is not liable for:

  • Indirect damages or lost profits.
  • Errors in AI-generated content.
  • Service interruptions due to force majeure (e.g., power outages, natural disasters).

9. Termination

By Client: Cancel with 30 days' notice (no refunds for prior payments).

By Creative AI: For violations of these terms or fraudulent use.

10. Governing Law and Jurisdiction

Primary HQ: California, USA (for international disputes).

Peruvian Clients: Jurisdiction in Lima, Peru, under Law No. 29733.

EU: User's local jurisdiction for EU clients (GDPR Art. 79).

11. Modifications

Changes will be notified via email or our website. Continued use implies acceptance.
